CONSTRUCTION
According to the exempt and complying development code of 2008, you do not need council approval to undertake some NSW minor works. Backyard studios and cabanas have become popular in the state over the last ten years. The exempt code requires that certain development standards be met to construct or install a cabana or backyard.

The development standards include:

Only two 20m² developments are allowed on residential land and only two 50m² developments on rural land, provided the structure is non-habitable.

The structure should not be higher than 3m above ground level.

There should be a boundary spacing of at least 900mm.
A non-habitable room includes a cabana, bathroom, darkroom, sewing room, hobby room, garage, girl cave, home gym, man cave, cubby house, fernery, kid's playroom, art studio, gazebo, pantry, music room, toilet, teenage retreat, and so on.
